Can unpermitted, nonconforming, structures be converted to (J)ADU's?

The Planning Division shall not deny an application on the basis that pre-existing structure was built without Building and/or Planning permits as long as the structure was built before 2020 and has the potential to meet health and safety standards.

The Planning Division shall inform the applicant that there may be additional costs to bring the structure up to code (i.e., fire-related setbacks) but cannot deny an application due to existing non-conformities. If through the Building permit process, the (J)ADU can be brought into compliance, then the (J)ADU shall be allowed, but it is the responsibility of the Building Division to determine this and is not the responsibility of the Planning Division to determine the structure can be brought to Building Code compliance during the Planning review process.

If the structure was built without permits after 2020, it must meet all ADU development regulations as if it were a new construction proposal.
